Application for Tradex Order

Application for Variation of an Order to Include or Exclude Particular Goods

The holder of a Tradex order may apply for a variation of the order in relation to either or both of the following:

  • the exclusion from the order of goods of a kind or description specified in the order; and/or
  • the inclusion in the order of eligible goods of a kind or description not already specified in the order.

To apply for a variation to your Tradex Order you will need to download a copy of the Application Form (see below), complete it and lodge it with your nearest AusIndustry State Office. If you require any assistance to complete the form, please contact the AusIndustry Hotline on 13 28 46.

If any administrative details change in relation to applicants (eg. a change of company name, address, or contact details) the standard AusIndustry Change of Applicant Details form, available at any AusIndustry Regional Office, should be used.

Duty Liability and Payment

This form is to describe the circumstances in which the holder of a Tradex order becomes liable to pay Tradex duty, and to calculate and pay applicable Tradex duty. For example, a holder may import goods that were originally intended to be exported in accordance with the requirements of the Tradex Scheme, however, for whatever reason (eg the export order was cancelled) the goods are sold in the domestic market. In this circumstance, the holder becomes liable to pay Tradex duty.

Application for Reconsideration of Certain Decisions made by the Secretary

Decisions subject to review
A person may apply to the Secretary of the Department of Innovation, Industry, Science and Research, within 28 days after the day on which the notice of the decision was given to the person, for a reconsideration of the following decisions:

  1. A decision by the Secretary to wholly or partly refuse an application by that person for a Tradex order under section 11 of the Tradex Scheme Act 1999 (the Act);
  2. A decision by the Secretary to wholly or partly refuse an application by that person for a variation of a Tradex order under section 13 of the Act;
  3. A decision by the Secretary to suspend a Tradex order, held by that person, under section 17 of the Act;
  4. A decision by the Secretary to revoke a Tradex order, held by that person, under section 19 or 19A of the Act.

The application must be made in accordance with this approved form.

The Secretary must decide, not later than 28 days after the day on which the application for reconsideration is lodged, whether to affirm the original decision or to substitute any other decisions that the Secretary might have made.
